Group 13 Constitution and Bylaws

-CONSTITUTION-

 

WHEREAS  the Group 13 Cadet Advisory Council (GP 13/CAC) is intended to provide an organization where cadets gain leadership experience at the group level, and

 

WHEREAS  the Group 13 Cadet Advisory Council is intended to aid the Group Commander and the Group Cadet Programs Officer in monitoring and implementing the Cadet Program; and

 

WHEREAS  the Group 13 Cadet Advisory Council shall make recommendations for improving and running the Cadet Program, and

 

WHEREAS  the Group 13 Cadet Advisory Council recognizes the primary mission of Group 13 as, “ To recruit, organize, and train a group of Composite, Senior, and Cadet Squadrons to be ready, willing and able to respond at any time to execute any type of sustained air and ground emergency services operation given to us by CAP National Headquarters, The United States Air Force, the Department of Homeland Security, or any other Federal, State, or Local governmental agency.”

 

NOW THEREFORE BE IT RESOLVED that we, the charter members of the Group 13 Cadet Advisory Council, Civil Air Patrol, hereby adopt this document as the Constitution of the Group 13 Cadet Advisory Council.

 

ARTICLE I – GENERAL

1.    The Group 13 CAC (GP13/CAC) is an organization convened by the order of the

       Group Commander in accordance with CAPR 52-16, Chapter 3.

 

ARTICLE II – TERM

1.    The GP13/CAC term begins 1 April and lasts through 31 March of the following

       year.

 

ARTICLE III – OBJECTIVES AND PURPOSES

1.    To aid in expressing the views of cadets within Group 13 and to present them to the

       Group 13 Cadet Programs Officer.

2.    To provide an alternative form of communication for cadets within Group 13.

3.    To ensure that suggestions for improving the cadet program are heard.

 

ARTICLE IV – POWERS

1.    The CAC can make recommendations but has no authority to implement them.

 

ARTICLE V – MEMBERSHIP

1.    Any cadet in Group 13 is eligible to be a member of the GP13/CAC.

 

ARTICLE VI – MEETING SCHEDULE

1.    In order to attain maximum participation in the regularly scheduled meetings, they

shall be conducted in tandem with the Group 13 Commanders Call.

 

2.    Special meetings may be called by the Group 13 Commander, Cadet Programs Officer, or the GP13/CAC chairman.

 

ARTICLE VII – VOTING PRIVILEGES

1.    In order to encourage regular participation by representatives, a squadron’s primary

       representative must attend a minimum of 67% (“two out of the last three”) regularly

       scheduled meetings to exercise voting privileges. This is intended to be a stop-gap

       measure to insure the council is not prohibited from continuing its business.

2.    When less than 67% attendance is recorded, a member’s voting privileges are to be:

a.        delegated to his/her unit’s assistant representative, provided that the assistant

representative’s attendance is in compliance, or

b.        suspended by the chair until attendance improves.

 

ARTICLE VIII – FUNDS AND PROPERTIES

1.    GP13/CAC may receive gifts, bequests, devices, legacies, and donating to complete

       its objectives.

 

ARTICLE IX – AMENDMENTS

1.    This constitution may be amended at any time at a CAC meeting, with the approval

        of two-thirds of the voting members and with the approval of the Group 13 Cadet

        Programs Officer, or his appointee.

2.    The GP13/CAC shall adopt and maintain Bylaws for the administration of the

        activities, business, and affairs of the GP13/CAC.

 

 

 

 

-BYLAWS-

 

ARTICLE I – INTRODUCTION

These Bylaws are adopted to the constitution of the GP13/CAC.

 

ARTICLE II – MEMBERSHIP

Section I – Composition:

The GP13/CAC will consist of one primary and one assistant representative from each Squadron.

 

One primary representative and one assistant representative from GP13/CAC will be selected in a manner approved by the Group Commander, or his appointee, to represent Group 13 in the Texas Wing CAC.

 

Upon taking office, the GP13/CAC Chair will yield representation of his or her Squadron to his/her unit’s assistant representative.

 

Squadron level representatives will be identified by the wearing of a green cord as outlined in CAPR 52-16, Chapter 3, Figure 3-1.

 

Section II – Eligibility

To be eligible for membership in the GP13/CAC, a cadet must be a member in good standing of Group 13.

 

Section III – Duties

Representatives shall attend meetings regularly, participate actively, submit a Squadron Report, and inform their Squadron members of the activities of the GP13/CAC.

 

Section IV – Terms

The term of office is one year, with two terms maximum per echelon. The beginning of the term is 1 April and lasts through 31 March.

 

ARTICLE III – OFFICERS

Section I – Chairman

The Chair of the council be elected by the council and will be responsible for the following:

·         Setting the Agenda

·         Guiding and directing the meeting

·         Forming committees when necessary

·         Send and receive correspondence related to the CAC

·         Related duties as required

·         Serve as recorder in absence of vice chair and recorder

 

 

 

 

Section II – Vice Chairman

The Vice Chair of the council shall be elected by the council and will be responsible for the following:

·         Assist in duties of the chairman

·         Serve as chairman in the absence of the chairman

·         Serve as recorder in the absence of the recorder

·         Related duties as required by the chairman

 

Section III – Recorder

The Recorder of the council shall be elected by the council and will be responsible for the following:

·         Taking roll and recording minutes

·         Distributing copies of the attendance, roll, and minutes to the council members, Group Cadet Programs Officer, and Wing CAC.

·         Serve as chair in the absence of the vice chair and chairman.

 

ARTICLE IV – OPERATIONS

Section I – Meetings

1.    Meetings must be moderated by either the Chair, Vice Chair, or Recorder. The

       Group Cadet Programs Officer, or his appointed representative, must be present

       during all meetings to serve as Senior Member Advisor to the GP13/CAC.

 

       Other senior members are welcome to attend with the prior approval of the advisor.

       The Group Commander or his appointed representative is welcome to any and all

        meetings without prior approval. All cadets and seniors of Group 13 may attend any

        GP13/CAC meeting (space permitting) but must follow the rules of the meeting.

 

2.    Issues of discussion that preclude the GP13/CAC from having a timely and concise

       meeting will be put to a committee consisting of at least three representatives

       (primary or assistant) and chaired by one primary representative.

 

3.    A vote on any issue, policy, recommendation, etc., shall occur when the proper

       motion has been made and seconded and will be passed by a simple majority. Voting

       may only be conducted when a quorum of two-thirds of the representatives with

       voting privileges are present. Each representative  must have a current CAPF 2a on

       file at Group Headquarters. In the event of a tie, the Chair will cast the deciding vote.

 

4.    Meetings will be conducted in a professional manner with Roberts Rules of Order

       serving as the guiding principles. Visitors shall respect the autonomy of the council

       and refrain from speaking until properly recognized by the Chair.

 

Section II – Agenda

1.    Any special agenda items should be submitted to the chair no later than ten days

       prior to the meeting.

 

2.    The will be distributed to representatives before the meeting.

Section III – Minutes

1.        The minutes shall mirror the agenda.

 

 

 

 

-AMENDMENTS-

Constitution

 

 

Amendment I

Article VI, Section 1, shall be revised to read as follows:     “In order to attain maximum participation in the regularly scheduled meetings, they shall be conducted on the second Saturday of every month, at the same location as the Group 13 Commanders Call OR, if the Commanders Call is moved to a different date, the CAC will meet at David Wayne/Hooks Airport, Delta Composite Squadron facilities, unless otherwise scheduled by the Chair.”
